Real Estate Stuffs IS NOT authorized by, sponsored by, or otherwise associated with the trademark owner. You agree that any artwork submitted or requested is a representation and warranty to us that you have written authorization, if needed, to order its reproduction. It is solely your responsibility to determine whether any design you may create using the design tools made available to you by Real Estate Stuffs, infringes, or may be subject to a claim of infringement upon the trademark, copyright, or other rights of a third party. You should consult with an attorney as to whether a design you create may infringe upon the rights of another party.
Indemnification
Indemnification When using our site, the customer represents that they have the legal right to produce all printed materials ordered from Real Estate Stuffs. In the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a “Claim”) is made or commenced against Real Estate Stuffs based upon, relating to or arising from the alleged wrongful acts of the customers, or alleging that the printing performed or product produced by Real Estate Stuffs ordered by the customer: (a.) infringes any copyright, patent or other proprietary right of any person; or (b.) contains matter that is libelous, slanderous, defamatory, scandalous or obscene, the customer shall indemnify and hold Real Estate Stuffs harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1.) defending Real Estate Stuffs against any such Claim (2.) paying any judgment or award against the customer; and (3.) reimbursing Real Estate Stuffs for any legal fees and expenses it reasonably incurs in responding.
Trademark Claims
To be considered effective, a notification of a claimed trademark violation must include the following information:
- The trademark, service mark, trade dress, name, or other indicia of origin (“mark”) that is claimed to be infringed, including registration number.
- The jurisdiction or geographical area to which the mark applies.
- The name, post office address and telephone number of the owner of the mark identified above.
- The goods and/or services covered by or offered under the mark identified above.
- The date of first use of the mark identified above.
- The date of first use in interstate commerce of the mark identified above.
- A description of the manner in which the Complaining Party believes its mark is being infringed upon.
- The precise location of the infringing mark, including electronic mail address, etc.
- A good faith certification, signed under penalty of perjury, stating:
- The content infringes the rights of another party,
- The name of such said party,
- The mark [identify mark] being infringed, and
- That use of the content claimed to be infringing at issue is not defensible.
